{"id":65352,"date":"2008-12-14T17:57:55","date_gmt":"2008-12-14T17:57:55","guid":{"rendered":"https:\/\/zonda-develop.go-vip.net\/concrete-construction\/article\/restricted-access_o"},"modified":"2008-12-14T17:57:55","modified_gmt":"2008-12-14T17:57:55","slug":"restricted-access_o","status":"publish","type":"post","link":"https:\/\/zonda-develop.go-vip.net\/concrete-construction\/projects\/infrastructure\/restricted-access_o\/","title":{"rendered":"Restricted Access"},"content":{"rendered":"<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\"> <\/div><div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\"> <p class=\"wp-block-paragraph\">Intelligent transportation systems (ITS) combine information and communications technologies with vehicles and infrastructure to improve traffic routing and travel times, and trim fuel consumption. For years, supporters called for the technologies to be made part of the normal government funding process rather than being treated as something fit only for small pilot projects.<\/p> <p class=\"wp-block-paragraph\">While that goal has been achieved, there&#8217;s a downside.<\/p> <p class=\"wp-block-paragraph\">The Federal Highway Administration&#8217;s (FHWA) Transportation Technology Innovation has been used to steer taxpayer money to a company \u2014 Traffic.com Inc. \u2014 chosen not by competitive bids but by political deals. The program maintains the company&#8217;s control over data by deploying federal grants improperly to sell its offerings to cities and states. Legislators from both sides of the aisle have charged the U.S. DOT with evading provisions intended to open the program to competition.<\/p> <p class=\"wp-block-paragraph\">ITS is an attractive tool to help government agencies combat congestion, but most commercial traveler information providers and public-sector partners can&#8217;t access the most valuable data. The program needs to be replaced with an initiative designed from the start to serve the public interest.<\/p> <p class=\"wp-block-paragraph\">Traffic.com Inc. is a NAVTEQ company that provides personalized real-time traffic information. Its involvement in congestion-mitigation initiatives goes back to language inserted into the 1998 federal surface transportation program \u2014 the Transportation Equity Act for the 21st Century \u2014 that authorized an \u201cintelligent transportation infrastructure program\u201d for the \u201cmeasurement of various transportation system activities\u201d to aid in planning and analysis. The law specified that the program would:<\/p> <ul class=\"wp-block-list\"> <li>Be initiated in Philadelphia and Pittsburgh; Pennsylvania is home to Republican Bud Shuster, who was chair of the House Transportation and Infrastructure Committee at the time.<\/li> <li>Provide data from an expanded \u201cinfrastructure of the measurement of various transportation system metrics\u201d in more than 40 metropolitan areas at a cost of $2 million each.<\/li> <li>Support private technology commercialization initiatives to generate revenues to be shared with transportation departments.<\/li> <li>\u201cAggregate data into reports for multipoint data distribution techniques.\u201d<\/li> <li>\u201cUtilize an advanced information system designed and monitored by an entity with experience with the DOT in the design and monitoring of high-reliability, mission-critical voice and data systems.\u201d<\/li> <\/ul> <p class=\"wp-block-paragraph\">Out of this early language grew a government-funded and -supported monopoly for traffic information data.<\/p> <p class=\"wp-block-paragraph\">In a June 2001 Federal Register notice, the DOT announced that two other cities would be included and invited additional government entities to apply for grants to create a regional and national information-sharing system. State and local transportation agencies had to be willing to work with \u201ca private partner preselected\u201d by the DOT: Traffic.com.<\/p> <p class=\"wp-block-paragraph\">In early 2001, control of the House Transportation and Infrastructure Committee passed from Shuster to Republican Don Young of Alaska. During Young&#8217;s tenure, Traffic.com executives contributed to his reelection campaign and political action committee, particularly at the beginning of his tenure when the company was lobbying Congress to get funds appropriated for this program and surrounding the passage of TEA-21&#8217;s successor, SAFETEA-LU, in 2005. <i>The Hill<\/i>, a Capitol Hill newspaper, reported that the company spent more than $900,000 over the years.<\/p> <p class=\"wp-block-paragraph\">Although TEA-21 authorized the program, funds needed to be appropriated to make it happen. Traffic.com supporters managed to get $50 million appropriated in the FY2001 Transportation Appropriations Bill by inserting language that the program would be instituted in 25 additional metropolitan areas, with a $2 million federal grant to each.<\/p> <p class=\"wp-block-paragraph\">The DOT&#8217;s position on the propriety and legality of this move has varied: At times it has been uneasy about it and once challenged it; other times it seemed to be a reluctant defender. In 2001, FHWA&#8217;s deputy executive director resisted pressure from Shuster to direct $50 million in additional funds to the company without competition, saying that to do so \u201cwould significantly change the scope of the (prior) contract and require re-competition.\u201d<\/p><\/div> <!--nextpage--><div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\"> <\/div><div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\"> <p class=\"wp-block-paragraph\">To get around the threat of competitive procurement, the company worked on a novel legislative maneuver. Although the program has virtually nothing to do with defense, the FY2002 defense appropriations bill included language that authorized the DOT to extend the program contract to \u201cthe same competitively selected consortium leader\u201d selected for the earlier pilot contract for Philadelphia and Pittsburgh.<\/p> <p class=\"wp-block-paragraph\">Transportation Secretary Norman Mineta then exercised his authority to expand the program to 25 more cities on a sole-source basis. Soon afterward, the FHWA formally signed the task order enabling Traffic.com to be the sole-source provider for services under the program&#8217;s umbrella.<\/p> <p class=\"wp-block-paragraph\">From 2002 to 2004, state and local agencies representing 14 cities \u2014 including Boston, Chicago, and Washington, D.C. \u2014 signed up for the program. Traffic.com tapped into its existing data sources and installed its pole-mounted radar traffic sensors to create its \u201cDigital Traffic Pulse sensor network.\u201d<\/p> <p class=\"wp-block-paragraph\">As discussions about the reauthorization of the transportation bill were heating up in early 2005, several of the company&#8217;s competitors complained to their elected representatives. Wavetronix of Lindon, Utah, was one of the most outspoken. It markets the \u201cSmartSensor\u201d line of digital wave radar traffic sensors, which compete with Traffic.com&#8217;s pole-mounted traffic sensors. Wavetronix sought the assistance of its state&#8217;s senior senator, Republican Orrin Hatch.<\/p> <p class=\"wp-block-paragraph\">Through the spring and summer of 2005, Hatch, joined by several House members led by New York Democrat Anthony Weiner, worked to add language to SAFETEA-LU that would open up the program to competition. In the end, he used the conference process to add the language, which said in part that for the program&#8217;s new Part II, \u201cthe Secretary shall award, on a competitive basis, contracts for the deployment of intelligent transportation infrastructure systems that have been accepted by the Secretary in congested areas.\u201d<\/p> <p class=\"wp-block-paragraph\">On the same day that Hatch and Weiner were celebrating their legislative triumph, Young inserted a statement in the Congressional Record that intended to starve funding for the Part II phase. The statement said it was \u201cthe conferees&#8217; intent that all of the existing $54 million that has been provided for the current contracting team would be used to carry out the existing contract to deploy the current highway congestion information system under Part I.\u201d<\/p> <p class=\"wp-block-paragraph\">In other words, the DOT should continue the program under the no-compete terms and ignore the Part II provisions unless new funds were forthcoming.<\/p> <p class=\"wp-block-paragraph\">Young got his way. All 11 agreements signed by state and local governments \u2014 including the cities of Atlanta, Las Vegas, San Jose, Calif., and Baltimore \u2014 under SAFETEA-LU have been under Part I provisions of the law. In January 2007, Hatch wrote Transportation Secretary Mary Peters, Mineta&#8217;s successor, asking why none of the agreements utilized Part II. Her response contained a list that confirmed his assertion that the DOT was managing the program to maintain Traffic.com&#8217;s involvement, but she avoided an explanation as to why.<\/p> <p class=\"wp-block-paragraph\">Hatch wrote Peters again, complaining that her response \u201cdoes not address my central concern: why the monopoly for Traffic.com has largely continued since the passage of language in SAFETEA-LU specifically was designed to eliminate that monopoly.\u201d Peters delegated the response to the department&#8217;s acting general counsel, who claimed the statute \u201cexpressly requires the Department to complete the original contract, [so] the majority of the funding that has been provided is committed to Part I.\u201d<\/p> <p class=\"wp-block-paragraph\">Neither Hatch nor Weiner was satisfied with that answer.<\/p><\/div> <!--nextpage--><div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\"> <\/div><div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\"> <p class=\"wp-block-paragraph\">On Sept. 19, 2007, Hatch wrote to DOT Inspector General Calvin Scovel to \u201crequest a review of the funds and administration\u201d of the program. On Jan. 29, 2008, the Office of the Inspector General announced that it was conducting a comprehensive audit of the program that would cover both the \u201cpre-SAFETEA-LU\u201d and \u201cpost-SAFETEA-LU\u201d time periods.<\/p> <p class=\"wp-block-paragraph\">Details of the agreements with state and local agencies signed by the DOT and Traffic.com have never been made publicly available on the department&#8217;s Web site. However, as a result of a Freedom of Information Act request, the watchdog group Sunlight Foundation obtained many of the agreements. An analysis shows:<\/p> <ul class=\"wp-block-list\"> <li>The \u201clocal agency cash match\u201d requirement has changed. In all but three of the agreements (verified in one of the letters from Peters to Hatch), the DOT has waived the usual 20% local agency cash match that&#8217;s normally a requirement to access department grants for ITS-earmarked programs. Instead, a new \u201cnon-Federal match\u201d was substituted in which Traffic.com&#8217;s investment in its business was considered a satisfactory match.<\/li> <li>Public-sector partners are prevented from providing traveler information to the public. The agreements usually restrict agencies to using data internally, preventing them from, for example, providing travel times computed from the data on variable message signs or in \u201c511\u201d telephone traffic services.<\/li> <li>Revenue-sharing returns to Traffic.com&#8217;s coffers. Revenue sharing provisions generally don&#8217;t involve unrestricted sharing with the state\/local partner; shared funds must go back into the program.<\/li> <\/ul> <p class=\"wp-block-paragraph\">In coming years, the widespread availability of accurate and comprehensive real-time traffic information will be vitally important to our nation&#8217;s mobility, particularly because of shortfalls in the Highway Trust Fund, which has funded most new roadways.<\/p> <p class=\"wp-block-paragraph\">While the DOT sees the building of new, privately financed toll roads and their variants as the primary solution to this conundrum, the ability to better use existing roadways must play a larger role in the solution.
