Not Necessarily Necessary<\/b> <p class=\"wp-block-paragraph\">Highway departments can continue using cheaper foreign steel for bridge projects, despite attempts by Congress to constrict the practice.<\/p> <p class=\"wp-block-paragraph\">Congress is near completing a second piece of legislation with \u201cadvisory\u201d language concerning \u201cBuy America\u201d provisions for projects funded by the Federal Highway Administration (FHWA). Congress first addressed the issue in 2005 when it added a non-binding resolution to SAFETEA-LU allowing the FHWA to waive the Buy America requirement only if using foreign steel would lower a project&#8217;s cost by at least 25%.<\/p> <p class=\"wp-block-paragraph\">The FHWA believes the requirement can be waived if using U.S. steel on a bridge <i>component<\/i> (i.e., the foundation, superstructure, deck, or approaches), rather than the entire project, will cost 25% or more than using foreign steel.<\/p> <p class=\"wp-block-paragraph\">When the House overwhelmingly passed a SAFETEA-LU technical corrections bill (H.R. 1195) in March, the legislation declared the FHWA&#8217;s application of the Buy America exemption \u201cinconsistent\u201d with last year&#8217;s provision and requires the U.S. Secretary of Transportation to provide detailed justifications for issuing waivers. The Senate will most likely pass that bill in the near future.<\/p> <p class=\"wp-block-paragraph\">In the meantime, the FHWAis sticking to its guns.<\/p> <p class=\"wp-block-paragraph\">When he appeared before the House Transportation and Infrastructure Committee on April 24, FHWA administrator J. Richard Capka said he had no intention of changing the agency&#8217;s interpretation of Buy America requirements: \u201cIn our view, the words of section 313 of the federal code require us to apply the Buy America requirement on a contract-by-contract basis.\u201d<\/p> <p class=\"wp-block-paragraph\">The distinction is not an inconsequential issue for public infrastructure owners.<\/p> <p class=\"wp-block-paragraph\">The California Highway Department, for example, received a waiver to use foreign steel on one of the 16 contracts making up the East Span Seismic Safety Project on the Bay Bridge in San Francisco, saving $400 million on the $1.8 billion contract. Had the FHWA used the $5 billion project cost as the basis for judging the suitability of a waiver, the waiver would have been denied.<\/p><p class=\"wp-block-paragraph\"><b>Fhwa Broadens Culvert Pipe Options<\/b> <\/p> <p class=\"wp-block-paragraph\">Highway departments must consider materials beyond concrete or steel pipe on drainage projects.<\/p> <p class=\"wp-block-paragraph\">The FHWA&#8217;s elimination of \u201cAppendix A\u201d\u2014tagged onto \u201cSummary of Acceptable Criteria for Specifying Types of Culvert Pipes\u201d\u2014means public works departments must get bids for alternative pipe materials if the materials will provide \u201csatisfactory quality\u201d and are \u201cequally acceptable on the basis of engineering and economic analyses.\u201d The public works departments themselves determine if the materials meet these criteria. The point: to stretch federal highway dollars and curb the sole-source habit some states have fallen into.<\/p><\/div> <!--nextpage--><div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\"> <\/div><div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\"> <p class=\"wp-block-paragraph\">The FHWA is encouraging departments to consider pipe made of acrylonitrile butadiene styrene, polyvinyl chloride, high-density polyethylene (HDPE), and other plastics.<\/p> <p class=\"wp-block-paragraph\">Plastic pipe isn&#8217;t necessarily cheaper than concrete or steel: sometimes it is, sometimes it isn&#8217;t, says Jim Goddard, chief engineer of Advanced Drainage Systems Inc., the world&#8217;s largest producer of corrugated HDPE pipe. He points to a study by the Ohio DOT, which shows that with competition for a contract for 18- to 48-inch diameter pipe, the cost of the total installed job drops 22% compared to a sole-source contract.<\/p> <p class=\"wp-block-paragraph\">Utah, California, and Oregon have requested bids on plastic pipe for culverts and storm sewers for years, but most states have not\u2014for several reasons.<\/p> <p class=\"wp-block-paragraph\">When Appendix A became a part of FHWA regulations 30 years ago, there were many more suppliers of concrete and steel pipe. Those markets have contracted so much over the past three decades that there may only be one supplier of concrete and steel pipe in any given state.<\/p> <p class=\"wp-block-paragraph\">Also, plastic culvert pipe was nearly unheard of when Appendix A was codified, and its acceptance was inhibited by the American Association of State Highway and Transportation Officials (AASHTO), which published standards only for plain galvanized or asphalt-coated reinforced concrete and corrugated steel pipe.<\/p> <p class=\"wp-block-paragraph\">Even as the pipe market changed and AASHTO added standards for materials such as HDPE, some state departments continued to use Appendix A to justify soliciting bids only from concrete or steel pipe suppliers.<\/p> <p class=\"wp-block-paragraph\">Edmund Parker, PE, chief engineer at the Rhode Island DOT, says his state uses HDPE pipe for some applications.<\/p> <p class=\"wp-block-paragraph\">\u201cIf backfill isn&#8217;t done properly, 24-inch-plus plastic pipes can become oval,\u201d he says. Parker adds he can continue to consider or ignore plastic pipe on a project-by-project basis based on the caveat in the FHWA&#8217;s final rule. However, his and other government agencies must be able to document their material selection decision on a project or program basis.<\/p> <p class=\"wp-block-paragraph\">Tony Radoszewski, executive director of the Plastics Pipe Institute, says members that sell corrugated polyethylene pipe have asked the association to alert public works departments to the elimination of Appendix A. \u201cThere&#8217;s a lack of awareness out there to the change,\u201d he says. To that end, the group&#8217;s member companies have written letters, visited, and made phone calls to help build awareness.<\/p><p class=\"wp-block-paragraph\"><b>At Last: Corps Of Engineers Funding Approved<\/b> <\/p> <p class=\"wp-block-paragraph\">Congress is poised to authorize a U.S. Army Corps of Engineers authorization bill that will open the door to funding for hundreds of public works projects in 2008, to the tune of about $1.6 billion.<\/p> <p class=\"wp-block-paragraph\">Congress usually passes a Corps authorization every two years, but it&#8217;s been six years since the last reauthorization.<\/p> <p class=\"wp-block-paragraph\">Besides the typical flood-damage reduction, navigation, hurricane and storm damage reduction, and environmental restoration projects, the Water Resource Development Act (H.R. 1495) also contains \u201cenvironmental infrastructure\u201d\u2014i.e., wastewater and drinking water\u2014projects. While cities and counties have funded these projects with loans from the U.S. EPA&#8217;s Clean Water and Drinking Water State Revolving Funds, some haven&#8217;t qualified for technical and other reasons.<\/p> <p class=\"wp-block-paragraph\">While the backlog of projects has been authorized, the Corps still has to pay for construction out of its annual appropriations from Congress. So there&#8217;s no telling how quickly these projects will get done.
