{"id":44963,"date":"2016-02-16T17:49:28","date_gmt":"2016-02-16T17:49:28","guid":{"rendered":"https:\/\/zonda-develop.go-vip.net\/concrete-construction\/article\/avoid-ada-non-compliance_o"},"modified":"2016-02-16T17:49:28","modified_gmt":"2016-02-16T17:49:28","slug":"avoid-ada-non-compliance_o","status":"publish","type":"post","link":"https:\/\/zonda-develop.go-vip.net\/concrete-construction\/projects\/infrastructure\/avoid-ada-non-compliance_o\/","title":{"rendered":"Avoid ADA non-compliance"},"content":{"rendered":"<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\">\r <p class=\"wp-block-paragraph\">As an Americans with Disabilities Act (ADA) consultant and trainer, I\u2019m discouraged that government entities often don\u2019t take the basic steps to comply with the law.<\/p>\r <p class=\"wp-block-paragraph\">The most-common mistakes are: <br><\/p><ul class=\"wp-block-list\"><li>Assigning an employee who knows nothing about the law to be ADA Coordinator.<\/li><li>\r Failing to <a href=\"http:\/\/www.pwmag.com\/ada-compliance\/no-one-sues-themselves_o.aspx?dfpzone=general\" target=\"_blank\"><span >organize an ADA committee<\/span><\/a> or, if that\u2019s been done, failing to include people with differing disabilities and\/or advocates for the disabled.<\/li><li>\r Failing to follow up on the committee\u2019s suggestions.<\/li><li>\r Not putting together a transition plan.<\/li><li>\r Not budgeting for yearly improvements.<\/li><li>\r Not training each employee on his responsibilities related to the law.<\/li><li>\r Not having a proactive complaint process so action can be taken as needed.<\/li><li>\r Not documenting improvements <a href=\"http:\/\/www.pwmag.com\/codes-and-standards\/workplace-accommodations_o.aspx?dfpzone=general\" target=\"_blank\"><span >reasonable accommodations<\/span><\/a>, and transition plan updates.<p class=\"wp-block-paragraph\"><\/p><\/li><\/ul><p class=\"wp-block-paragraph\">In 1999, the <a href=\"http:\/\/www.justice.gov\/\" target=\"_blank\">U.S. Justice Department<\/a> (DOJ) began reviewing local and state government accessibility efforts. After the DOJ\u2019s thorough assessment, the public agency signs an agreement that details what must be done to comply.<\/p>\r <p class=\"wp-block-paragraph\">Since then, <a href=\"http:\/\/www.ada.gov\/civicac.htm\" target=\"_blank\">Project Civic Access<\/a> (PCA) has resulted in 218 settlement agreements with 203 localities in all 50 states, the District of Columbia, and Puerto Rico.<\/p>\r <p class=\"wp-block-paragraph\">Some PCA reviews were undertaken in response to complaints filed against the localities; others were initiated by a locality that receives DOJ funding and, under the Rehabilitation Act of 1973, is prohibited from discriminating on the basis of disability.<\/p>\r <p class=\"wp-block-paragraph\">Either way, compliance usually takes several years and hundreds of thousands of dollars to achieve, often overwhelming the agency.<\/p>\r <p class=\"wp-block-paragraph\">Trust me: They could have avoided this painful experience just by taking initial steps to comply.<\/p>\r <p class=\"wp-block-paragraph\">I wish I had been brought in to help the agency develop a transition plan, train, and provide ongoing advice so the review could be smoother and the outcome less traumatic.<\/p>\r <p class=\"wp-block-paragraph\">I\u2019d like your New Year\u2019s resolution to be to write an action plan for addressing the law\u2019s multidisciplinary requirements. If your agency has one, review and update it, if necessary.<\/p>\r <p class=\"wp-block-paragraph\">Many free resources are available:<br><\/p><ul class=\"wp-block-list\"><li>\r <a href=\"http:\/\/www.ada.gov\/pcatoolkit\/toolkitmain.htm\" target=\"_blank\"><span >www.ada.gov\/pcatoolkit\/toolkitmain.htm<\/span><\/a>: Contains a checklist and instructions for becoming accessible.<\/li><li>\r <a href=\"http:\/\/www.ada.gov\/civiccommonprobs.htm\" target=\"_blank\"><span >www.ada.gov\/civiccommonprobs.htm<\/span><\/a>: Provides the first steps for solving common problems at the city and county levels.<\/li><li>\r <a href=\"http:\/\/www.ada.gov\/smtown.htm\" target=\"_blank\"><span >www.ada.gov\/smtown.htm<\/span><\/a>: Is an excellent manual for small towns.<\/li><li>\r <a href=\"http:\/\/www.ada.gov\/civicac.htm\" target=\"_blank\"><span >www.ada.gov\/civicac.htm<\/span><\/a>: Lists the 218 agencies that have signed settlement agreements related to PCA reviews.
